In the name of God Amen, I James Cunningham, do make and publish this as my last Will and testament
hereby ——- and —— and making void all other Wills by me at any time made. First I direct that my
funeral expenses —— and all my just debts be paid so soon after my death as possible out of any money that I
may die possessing of or may first come into the hands of my executors. Secondly, I give and bequeth unto my
beloved wife my sorrell horse and her saddle and bridle. Also one bed and furniture and my press. Thirdly I
then wish my executor to sell all the balance of my estate both real and personal. Fourthly I give and bequeth to
my beloved brother Thomas Cunningham three hundred dollars in money. Fourthly I give and bequeth to all the
rest of my brothers and sisters, to wit, John Cunningham, Willis Cunningham, Nathaniel Cunningham, Anna
Patterson, Elizabeth Carroll, Mary Wilson, Amy Hogwood, Nancy Hamilton five dollars each. Fifthly I then
wish my wife Sarah Cunningham to have all the balance of my estate except what will pay the expenses of my
executor. Sixthly and Lastly, I hereby nominate and appoint John Cunningham my Executor. In witness
whereof I do to this my will set my hand and seal this 5th day of December 1839.

in our presence and we have subscribed our names hereto in the presence of the Testator this the 5ht day of

I, William Hightower, Clerk of the Court do hereby certify that the foregoing is a true copy of the original Will
of James Cunningham on file in my office Given under my hand this 11th day of January, 1840. William
Hightower Clerk


The Amy Hogwood mentioned is my 3rd Greatgrandmother, wife of Nicholas Paschal
Hagwood. I have never been able to trace her parents. Any help would be greatly
appreciated.
